This PIA is focussed on the management of the information the Risk Management Office receives to deliver the claims service on behalf of Government of Yukon for vehicles, real property, and liability.
The Risk Management Office (RMO), in Highways and Public Works, delivers enterprise risk management, loss prevention, claims, damage and loss, and insurance services across all of Yukon Government as defined by General Administration Manual (GAM) 1.1.
The operations of the Risk Management Office are guided by and financed via the Risk Management Revolving Fund (the Fund)(Financial Administration Act s48.02). The functions of the RMO has been delivered continuously in various forms since 1967.
The RMO operates Government of Yukon’s risk program. The RMO purchases large limit commercial insurance with a high self-retention or deductible, depending on policy, for property, liability, and medical malpractice. The RMO operates an approved self-insurance program for automobile 3rd party liability, in compliance with the Insurance Act and the Motor Vehicles Act (and future Traffic Safety Act).
A claim can made through the court system or using an out of court claims process. Information is collected in anticipation of legal action. A claim may result in litigation when a negotiated settlement cannot be reached. A claim may be transferred to one or more of Government of Yukon’s insurers.
When a claim is received, using form YG 6383 (hpw-claims-statement.pdf), the RMO will acknowledge receipt or may request additional information. The RMO may contact internal or external entities.
Most claims are assigned to our contracted independent loss adjuster. Claims related to significant property damage, bodily injury, fatality, complex liability, or issues that have public visibility or/and legal complexity are assigned to Department of Justice - Legal Services. A smaller subset of these claims are shared with our commercial insurers, via our broker, as required by our insurance contracts.
External information may be received from: the member of the public who experienced the incident; agents of the member of the public (lawyers, insurers); guardians/parents (when children are involved); YG’s contracted loss adjusting service providers; YG’s contracted broker; YG’s current or legacy insurers.
Internally information may be received from Government of Yukon employee(s) involved in an incident: the employee, supervisors; senior leaders; members of the legislative assembly; department health and safety representatives; the Department of Justice – Legal Services; and the Public Service Commission.
An annual anonymized loss run is shared with our broker and insurers for annual insurance renewal purposes and to comply with the purchasing requirements of commercial insurance contracts.
